Terms of Use
Please read these Terms of Use (“Terms”) carefully before accessing or using the DIRECT INN website, mobile application, and any related services (collectively, the “Platform”). By registering for or using the Platform, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not access or use the Platform.
1. Definitions
· “Guest” means any user who searches for, books, or uses accommodations, office spaces, chauffeur services, or luggage services via the Platform.
· “Host” means any user who lists or offers accommodations, office spaces, or related services for booking on the Platform.
· “Host Listing” means any individual listing of a home, chalet, office, chauffeur ride, or luggage service posted by a Host.
· “Booking” means a confirmed reservation of a Host Listing by a Guest.
· “Services” include home swaps (“SwapHome”), office swaps (“SwapOffice”), short-term rentals (homes, chalets, villas), chauffeur services, luggage storage/pickup & drop, and hosting services.
2. Acceptance of Terms
Your access to and use of the Platform constitutes your unconditional acceptance of these Terms and any future amendments. DIRECT INN reserves the right to modify these Terms at any time; changes become effective upon posting. You are responsible for reviewing the Terms periodically. Continued use after changes indicates acceptance.
3. Eligibility
You must be at least 18 years old and capable of entering into binding contracts under the laws of your jurisdiction. By registering, you represent and warrant that you meet these requirements.
4. Account Registration & Verification
1. Registration: You agree to provide accurate, current, and complete information during registration and to update it as needed.
2. Verification: DIRECT INN may require identity verification (e.g., government ID, passport, residency permit). Hosts must provide valid proof of ownership or authorization to list properties.
3. Account Security: You are responsible for safeguarding your password and account. You must notify DIRECT INN immediately of any unauthorized use.
5. Platform Services
DIRECT INN acts solely as an intermediary between Guests and Hosts. We do not own, manage, or control any Host Listings, accommodations, offices, vehicles, or luggage facilities. All contractual obligations are directly between Guest and Host.
6. Guest Terms
6.1 Search & Booking
· Guests may search for listings by location, date, price, amenities, and other filters. Results are provided “as is” and are subject to availability.
· When you complete a Booking, you agree to all listed terms, including the Host’s cancellation, change, no-show, check-in/out policies, and house rules.
6.2 Cancellation & Modification
· Guests may cancel or modify Bookings via the “My Reservations” section, subject to the Host’s stated policy.
· Host policies fall into four categories:
o Strict: No refund after confirmation.
o Moderate: Full refund if cancelled ≥ 4 days before check-in.
o Flexible: Full refund if cancelled ≥ 2 days before check-in.
o Free: Full refund if cancelled before 11:59 PM local time on check-in day.
· Some discounted or promotional Bookings may be non-refundable.
6.3 Check-In & Check-Out
· Guests must adhere to the Host’s specified check-in/out times. Early check-in or late check-out may incur additional fees per the Host’s rules.
· If you anticipate arriving late, you must notify the Host directly via in-app messaging.
6.4 No-Show & Non-Arrival
· If you fail to arrive without prior cancellation, the Host’s no-show policy applies and the Booking is non-refundable unless otherwise stated.
7. Host Terms
7.1 Listing Requirements
· Hosts must accurately describe their Listings, including photos, amenities, pricing, availability, and house rules.
· Hosts must maintain a safe, clean, and lawful environment and comply with all local regulations.
7.2 Pricing & Fees
· Hosts set their own nightly or swap rate. DIRECT INN may offer pricing tools and recommendations but does not guarantee occupancy.
· Hosts agree that DIRECT INN may deduct service fees and applicable taxes from Guest payments before remitting the remainder.
7.3 Booking Obligations
· Hosts must honor confirmed Bookings or provide suitable alternative accommodations.
· Hosts may require a security deposit; terms must be clearly disclosed in the Listing.
8. Chauffeur, Luggage & Other Services
· Chauffeur drivers and luggage couriers are independent service providers. DIRECT INN does not employ, supervise, or vet them beyond initial verification.
· Service-specific terms (e.g., pickup windows, weight limits, vehicle classes) are set by individual providers and must be accepted at booking.
· Real-time tracking and customer support are available via the Platform.
9. Payments, Fees & Refunds
1. Payment Processing: DIRECT INN processes all payments via secure, encrypted channels. We accept major credit cards and digital wallets.
2. Service Fees: Guests and Hosts pay service fees as disclosed at booking. Fees are non-refundable except as required by law or Host policy.
3. Refunds: Any refund due under these Terms will be processed to the original payment method within 7–10 business days of approval.
10. Compensation & Remedies
If a Listing is materially misrepresented (e.g., unavailable key amenity, unacceptable condition, unlawful refusal of access), Guests must notify DIRECT INN within one hour of check-in. DIRECT INN will endeavor to secure an alternative or issue a refund not to exceed the total Booking amount.
11. Disclaimer of Warranties & Limitation of Liability
· AS IS: The Platform and all Listings are provided “as is” and “as available.”
· No Warranty: DIRECT INN makes no warranties regarding Listings, services, or content, whether express or implied.
· Limitation: To the fullest extent permitted by law, DIRECT INN’s total liability to you for any claim arising from or relating to these Terms or the Platform shall not exceed the total fees paid by you in the 12 months preceding the claim.
12. Indemnification
You agree to indemnify and hold DIRECT INN and its affiliates harmless from any losses, claims, damages, liabilities, and expenses (including legal fees) arising out of your use of the Platform, your breach of these Terms, or your negligent or wrongful acts.
13. Intellectual Property
All content on the Platform—text, graphics, logos, button icons, images, software—is the property of DIRECT INN or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce or distribute any content without prior written permission.
14. Suspension & Termination
DIRECT INN may suspend or terminate your access and remove or edit your Listings at any time, without notice, for violation of these Terms or for any conduct DIRECT INN deems harmful to the Platform or its users.
15. Governing Law & Dispute Resolution
These Terms are governed by the laws of the Kingdom of Saudi Arabia. Any dispute arising under or relating to these Terms must be resolved exclusively in the courts of Riyadh.
16. Miscellaneous
· Entire Agreement: These Terms and any policies posted by DIRECT INN constitute the entire agreement between you and DIRECT INN regarding the Platform.
· Severability: If any provision of these Terms is held invalid, the remaining provisions will remain in full force.
· Waiver: DIRECT INN’s failure to enforce any right does not constitute a waiver of that right.
